Samoan Government Official Arrested in Branson

 (Springfield, MO) -- He may be one of the most prominent politicians to ever have been locked up in the Greene County jail.

For one week, an Associate Minister of Samoa was held in the jail facing federal felony charges of posing as a U.S. citizen and misusing a U.S. passport.

On Wednesday, he was released on a $100,000 bond that prevents him from leaving this area.  But the problem that put him in this predicament goes all the way back to the 1960s and it raises a lot of questions.

Since last week, letters have been pouring in to attorney John Kizer's office.

"A lot of people in his government has been contacting people in our government." says Kizer.

Letters with seals and signatures he doesn't normally see, including the Prime Mnister of Samoa.

 "I'm seeing a tremendous amount of support from his fellow countrymen and people around the world.  We got daily faxes, as did the jail and the U.S. Attorney's office." syas Kizer.

All with one purpose, getting the two federal felony charges filed against Hans Joachim Keil dropped.

"I think the Department of Homeland Security in this case has jumped to some conclusions that they shouldn't have." says Kizer.

Keil is the Samoan Associate Minister of Commerce, Labor and Industry and a member of the Samoan parliament.  Court records show he applied for U.S. citizenship in 1967 around the same time he was serving in the U.S. military.

"He served for four years in the U.S. Air Force during the conflict in Vietnam.  If that doesn't qualify you for citizenship, I don't know what does." says Kizer.

But even after his request, records show a certificate of citizenship wasn't issued.  He applied again in 1976.  Court records don't show what happened to that application, but in September 2006, he was issued a U.S. passport.

Since that time, a spokesperson for the Duttons says Keil's visited Branson multiple times to check in on a group of Samoans performing in the Island Fire show.

Then in March of this year, a United States Citizenship and Immigration Service director reported Keil is not a U.S. citizen.  But, when Keil came to the U.S. on September 6, he passed through customs in Los Angeles with no reported problems.  On September 9, he was arrested by the U.S. Marshal Service outside the Dutton Family Theatre in Branson.

"I think it's been an imperfect storm; a combination of one hand doesn't know what the other hand is doing and too many bureaucracies were involved.  He's not a danger to the community and since 9/11, there are terrorists out there and he's not one of them." says Kizer.

Many say this is a huge mixup, but it does raise concerns over how all of this was handled.  If the federal government knew of this issue since March, why was Keil allowed into the country earlier this month and then arrested three days later?
    
Keil does have a daughter who lives in the Springfield area, as well as other family in the U.S.
     
Keil has been a member of the Samoan parliament since 1988 and voted to pass anti-terrorism efforts in his country.

Joe Keil has not made a mistake. His passport has been renewed 7 times in over the last 41 years. Always through the correct Channels,I there was a mistake with his passport why did the US government not take action by not approving his passport in the first place 41 years ago...he has is a great leader and example to all. Let Mr Keil go home!!!

Hans Keil attorney is presenting a “bogus” defense, she says, “that the government's analysis of Keil's lineage was incomplete. She said her genealogical investigation showed that Keil's grandfather on his father's side was a German immigrant to Illinois who attained citizenship in 1896. That "derivative citizenship" would have been passed on to Keil's Samoan father and then to Keil himself, Sharma-Crawford said. The law that you apply when both parents are citizens is different than the law you apply when only one parent is a citizen," .
But this is bogus, because she hasn’t addressed the issue of Keil’s father’s citizenship…if his grandfather was indeed a US citizen, Keil’s father would only be a citizen if:
1. Keil’s grandmother were ALSO a US citizen
2. Keil’s father was born in the US
3. Keil’s grandfather resided in the US for some period during the 5 years prior to Keil’s father’s birth
There is no mention of this in any of her statements.
I think the truth is that this Keil guy was a Samoan diplomat who thought, and still thinks, that he’s above the law. You can get that sort of attitude when you live in Samoa and are a part of the government there…

Wow! Where did this last 'bogus' comment come from? ABOVE THE LAW? What do you call the US government not honoring diplomatic immunity of small pacific nations?

To lump Joe into the same category as some of the other crooks in the Samoan government is like aligning Abe Lincoln with Stalin.

Joe is the lone US confidant in the Samoan Government and most honest person in government, US or Samoan next to Orin Hatch. That's why these charges both by the Feds and posters are so remotely out of line. Anybody, who knows Joe, works with Joe, grown up with Joe or lives next to Joe like I do, know that's he's lead an exemplary life . Joe does not seek the limelight, yet he helps out people all the time and keeps it under wraps. He's a quiet and gentle man who speaks in a soft voice reminiscent of his demeanor, so to say somehow that he adheres to a life of dishonesty, deceit or crookedness is far from the truth and only reveals comments made by an over zealous government pencil pusher.
Joe is the only one in the current Samoan Administration that has stood up to our arrogant Prime Minister in public and voted against him in a very unpopular road bill that was recently passed. No, Joe hasn't pulled the wool over our eyes nor have we brushed little things under the carpet to protect his image. This man is the United States' only true friend in the Samoan government and representative for 14 island nations at the EU and this is how Uncle Sam treats a friend and fellow American? Imprison him and strip him of his citizenship??

Thank goodness Judge England today has dismissed the case because a bailout couldn't supply enough raw eggs to cover the faces of agent Barnhart, Foster, Hamilton & Spinelli and the US Embassy in NZ after this one.

Isn't this the same federal government and their minions who imprisoned Capion and Ramos?
