Branson Vacation Club Scams

Eleven out of 14 Branson-based vacation organizations have prompted complaints.

Susie and Fred Pfizenmaier used to love the Branson area, frequenting their favorite spots many times.

But, after an unpleasant encounter with a local travel club in October, the Clyde, Kan., couple say they doubt they will ever come back.

"It ruins our whole idea of what Branson is about," said Susie Pfizenmaier.

The couple say, despite meeting all the legal requirements on their end, they have not been able to rescind a $3,400 travel-club membership as promised.

"If someone is saying something, we don't know if we can trust them," Susie Pfizenmaier said. "And we're not the only one."

At the Missouri Attorney General Jay Nixon's Office in Jefferson City, Branson visitors have lodged dissatisfaction with 11 out of 14 registered travel clubs, five of which have more than 100 complaints.

Despite new state laws in 2005, travel clubs continue to generate discontent, and sometimes anger, from Branson tourists, who complain the clubs sell memberships that cost several thousands of dollars but sometimes are of little value.


In May, AARP Bulletin had an article about potential traps by some vacation clubs, citing an unhappy customer of a Branson travel club as an example.

That is not the kind of publicity Branson seeks.

"It has a detrimental effect on all businesses," said Ross Summers, executive director of the Branson/Lakes Area Chamber of Commerce and Convention & Visitors Bureau.

"It's not the way we want our visitors to come away from Branson," he said "We want them to have a good time and to come back."

Rep. Dennis Wood, R-Kimberling City, may introduce new laws to protect tourists from travel-club traps.

"We want to help the (vacation club) industry that offers a great service if they are real," Wood said. "But there's no regulation that requires those people to be bonded, to guarantee they will be in business in a year to provide the service."

"They may be in business for a few weeks and then open another location under another name," he said. "It's very easy to get into this type of business."

In 2005, Senate Bill 274, sponsored by the late Sen. Larry Taylor, sought to regulate travel clubs. The bill was signed into law on Aug. 25, 2005.

The law requires travel clubs operating in Missouri to register with the Attorney General's office, give customers three days to rescind contracts for membership and provide $50,000 surety bonds if they have been judged to have violated the law.

The law has worked, said Summers, because the number of complaints has declined and more consumer dollars have been recovered.

But there are loopholes, said Scott Holste, a spokesman for Nixon's office.

In an e-mail message, Holste said clubs have refused cancellation requests "because a consumer used a dinner coupon or some other insignificant gift given to them when they purchased the membership, and the club has argued the consumer 'accessed' club benefits and became ineligible for a refund."

In the case of the Pfizenmaiers, the couple said they wrote a letter of rescission and returned all membership materials to Travel More Now within three days, but the club declined the cancellation request, saying the couple had used two show tickets.

The Pfizenmaier said they offered to reimburse the tickets, but Travel More Now did not budge.

The 2005 state law says a consumer can rescind a travel club contract within three working days and receive a full or partial refund minus "any services actually consumed or utilized."

Travel More Now, which also had its name mentioned in the recent AARP story, is a long-standing travel club in Branson. Last year, it was at the center of a civil lawsuit by the attorney general in Taney County Circuit Court.

Nixon's office brought in nearly 30 witnesses from around the country to testify against the Branson club in a four-day trial, but Judge James Eiffert ruled in a one-page order that the state did not meet its burden to find the defendants liable.

The ruling came as a relief to Travel More Now, wrote its owner, Jim Kilroy, in a memo to his employees.

"We will continue to strive to create a positive business climate for legitimate travel clubs and continue to work on the remediation of practices and policies that fail to represent best practices for the industry or fail to serve the best interests of our prospects and our members," Kilroy wrote.

Travis Dunnahoe of Travel More Now was the driving force behind some state regulations of travel clubs.

Dunnahoe said complaints against Travel More Now represent about 4 percent of its total membership and "that for those members who may have found a lower price for their travel they have the advantage of the price-match guarantee."

But the attorney general's office also had some success.

Last year, Eiffert handed out a state-record penalty of $1.9 million after finding Vacation Travel Club to be in contempt of court over violation of state consumer-protection laws.

Since 2002, Nixon's office has sued 11 travel clubs, seeking hundreds of thousands of dollars for consumers.

At the convention and visitors bureau, Summers said his office is asking visitors to be cautious when signing up for travel club memberships.

We were TAKEN by Roark Vacation Club a few years back for this worthless package. Efforts to sell have been nil. We also will not return to Branson because of this fact. They prey on the older folks then talk so fast you can't follow them. WE WERE FOOLS to believe any of this garbage!!

I was scammed out of $7599 with Travel More Now's deceptive marketing tactics for a useless travel club package. They tricked me into buying 2 Red Lobster $30 gift cards for 1/2 price as I was leaving their office knowing that it would eliminate my ability to rescind my package purchase within the 3 alloted business days allowed by Missouri law. They also lied about selling my Time Share. They are well practiced scammers and have made a fortune with their well orchestrated presentation and total lies about what they can produce as a travel club. DO NOT SIGN ANYTHING or BELIEVE ANYTHING they tell you. I am joining a class action suit because the city of Branson and the state of Missouri does NOT CARE about its visitors. They only want your tourist dollars and allow this business to flourish right on their main street. I will only visit Branson again if there is a court trial because my once favorite vacation town has become a place of corruption. The head of the office professes to be a Man of God and preaches on Sundays. SHAME on all of you who work at Travel More Now. How can you possibly look at yourselves in a mirror???

When my wife & I were walking at an outlet mall in Branson' Missouri , a college aged man told us about a presentation that could save us a lot of money for us & our extended family members on travel, hotel rooms, & vacation packages . We attended this presentation put on by Travel More Now & became a member, we paid $3900, mainly because of all the promised savings. Since that sign-up date 8 years ago, we have paid our $159 annual fees, to preserve our membership, but they haven't found anything cheaper than what we could find on our own within our vacation schedule. When we signed up, if we found anything cheaper than TMN, the contract stated we would be paid the difference plus 10%. After 3 years they changed our contract with them, 'the difference plus 10% would not be honored from this date forward'. Only once did they come up with a cheaper flight than what we found, but it was 3500 miles longer, plus four additional landings & we would have lost two days to traveling & layovers. We have talked to representatives numerous times for each trip we planned on taking, but we have never been able to use their services. We believe this is Branson's biggest rip-off to senior's who come to relax & enjoy a vacation. This company & its owners should be ordered to paid back all membership & annual fees, & be stopped from scamming people who can't make use of their services.

Beware of Forever Grand Vacations (1316 West Hwy 76),that is renamed from Travel More Now at the same business address. Travel More Now (TMN) has well over 250 complaints filed with the Missouri Attorney General. Owner James Kilroy closed TMN and reopened Forever Grand Vacations (FGV) at the same location with the same travel club & timeshare sales scams. The FGV complaints are again being filed with the Missouri Attorney General. The only difference is they are now charging up to $9,995 for the same non-delivery of promises.

Roark Vacation Travel Club misrepresented the Club Resort Intervals membership stating that members would obtain 30 to 70 percent off of travel, cruises and lodging. This is false and when an attempt was made to Lingell Johnson to have the $3964.00 credited back he said it could not be done July 2, 2009. I really would hate to think that Gary Snadon would know about this scam and allow it to go on since I have quite a bit of respect for him.

Whatever happens do not get taken in by the scam of the Roark Vacation Travel Club.

IF EVER I KNOW OF A COMPANY THAT SHOULD BE EXPOSED ON NBC DATELINE IT IS FOREVER GRAND VACATION. THEY ARE A SCAM. THEY OFFER A PROGRAM TO SAVE MONEY ON TRAVEL AND AIRLINE TICKETS. THE PROGRAM IS WORTHLESS

I attended the ROARK VACATION CLUB (IN BRANSON MISSOURI) presentation over the weekend and decided to purchase with them. After returning to my resort I noticed a gift basket sitting on the kitchen counter...it was from Roark Vacation Club welcoming me as a new member. At the same moment something told me to get on the web and do some research and I'm so glad I did! I have read so many negative reviews and reviews about missing paper work. I looked over my paper work and noticed that the papers I had made notes on that they promised and I had them initial to cover all bases was missing! I decided to rescind my contract with them. Needless to say I went this morning and boy was I treated very rude, unprofessional, and cold! Lindell is the same person I dealt with and he smuggly told me I was lying and that all the paperwork was included in my documents and that he knew nothing of the paper I was speaking of. So he pretty much sat there and lied straight to my face. He was so rude and then another man came in since we were rather loud and immediately sided with Lindell...go figure. They did not want to sign my letter to rescind the contract or give me any type of statement saying I was rescinding my contract. I left very upset and boiling hot and on my way out Lindell gave me the finger. I politely told everyone in the lobby that Roark Vacations was a scam and very unprofessional! Oh and I'm a timeshare owner, they also tried to get me to give them the deed to my timeshare to bring the cost down even more it started at 15, 900 and they were going to give me 13, 000 for my timeshare and since I was a single parent they knocked off another 400 which would have brought my total to $2, 500. I'm just so thankful I realized the stupid mistake I was about to make before it was too late. Hope this helps someone not make a terrible mistake and get scammed by Roark Vacation Club in Branson Missouri
